We are pleased to inform you that Stratula & Asociatii Law Firm (“S&A”) if fully committed in assuring the protection of your personal data, in accordance with the provisions of the national applicable legislation, as well as with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

S&A processes your personal data collected through the websites www.stratula.com, www.avocati-fonduri-europene.ro, www.east-legal.com, or through the email addresses associated with these websites, or through fax, or in any other way, when you are contacting as a client, potential client, associate, employee, provider, potential provider, visitor, user, or when you contact us to apply for a position within our law firm, as well as when you contact us in any other way, in connection to our activity, regardless of the quality in which you are contacting us.

We comply with the legal provisions on the protection of personal data and implement and use technical and organizational measures for the protection of all operations related, directly or indirectly, to personal data, that prevent unauthorized or unlawful processing, as well as accidental or illegal loss or destruction.

In the following paragraphs we will inform you with respect to: categories of the processed personal data, legal basis of the processing, the purposes of processing, duration of processing, the recipients or categories of recipients of the personal data we process, your rights as holder of the processed personal data and the modality in which you may exercise these rights.

Categories of personal data we process

If you are a client or a client’s representative, we process your name, surname, domicile and personal identification number, your phone number, fax number, your email address and postal/domicile address, other necessary identification data, including the image on the identity document, special personal data or data referring to criminal convictions and crimes, contained in the contract concluded with us or which we receive in accordance with the above. We may also keep copies of your identity document, civil status documents, employment agreements, bank documents, other relevant documents from which your personal data arises.

Legal Basis of the Processing

We process your personal data: based on your consent; for the purpose of concluding and performing of a legal assistance agreement with you or with the entity which you represent, or of another type of agreement (collaboration, labor, services, etc); for compliance with a legal obligation of the lawyer; for the performance of a task carried out in the public interest; for the purposes of the legitimate interest; for the establishment, exercise or defense of legal claims in courts.

Purposes and Duration of Processing

  • Execution of the Legal Assistance Agreement concluded with you or with the company you represent, including the performance of our activities in your interest or in the interest of the company you represent, based on the agreement you have concluded with us,
  • Fulfillment of tax obligations related to the payment of the fee,
  • Drafting documents on your behalf or on behalf of the company you represent, according to the mandate given under the legal assistance agreement,
  • To submit to the public institutions and other institutions, authorities, organizations, companies and natural persons from Romania or from other countries, as a conventional representative or defender, claims and other documents necessary for the execution of the mandate entrusted to us under the legal assistance agreement,
  • The fulfillment of the obligations provided under the law for lawyers or for the Law Firm,
  • The fulfillment of our professional obligation to keep records of the agreements concluded within the Law Firm, as well as of all other registers, according to the law.

These documents will be stored as long as the lawyer's professional records are kept.

Regardless of the quality and modality in which you contact us (potential client, potential associate, potential employee, provider, potential provider, applicant to a position within S&A, etc) we process the data you submit to us -  your name, surname, domicile and personal identification number, your phone number, fax number, your email address, in order to communicate with you or in the view of concluding an agreement with you. These data will be stored as long as the lawyer's professional records are kept.

We process the data contained in your inquiries and information provided to us, as well as the data of your employees and of third parties, mentioned within the documents that you bring to your attention or that you hand them over by means of personal or remote communication, for:

  • Realizing your legitimate interest in receiving legal assistance and legal representation,
  • Achieving the public interest in fulfilling the lawyers' services and legitimate purposes of lawyers.

We hereby inform you that you are responsible for complying with GDPR provisions - Regulation 2016/679, regarding the way we collect these data you provide to us. These data will be stored during the execution of the agreement concluded between you and the Law Firm.

We do not use personal date for automatic processing or for personal profiling. You will not be subject to a decision when it’s based on automatic processing. We use technical means to store data safely. We do not process data for secondary purposes that would be incompatible with the purposes for which it was collected.

We strictly respect and ensure the professional secrecy. We do not disclose data unless it’s necessary in order to fulfill your interests or fulfill legal obligations. For us confidentiality is not only a lawyer’s professional obligation, but also an essential value of the lawyer's profession.

We revise collected data on a yearly basis and we analyse to what extent the storage is necessary for the mentioned purposes, for your legitimate interests, or for the lawyer/Law Firm to fulfill its legal obligations. Data that is no longer required will be erased.

Recipients of the Personal Data

We may disclose your personal data to other lawyers, experts, legal counsels, enforcement officers, mediators, IP counsellors, insolvency practicians, specialists, consultants, auditors, including the professional organizations of these categories, public institutions, judicial and arbitral courts, Public Ministry, as well as to any other persons or entities mentioned by you or which are adverse parties in the cases we are representing you, or in the cases where we represent our client, in the context or the performance of our professional services.

Your Rights and Modality of Their Exercise

You have the right access, intervention, rectification and data portability regarding the data you provide us, as well as the right to restrict our processing and even request the deletion of the data, to oppose to their processing and to withdraw your consent, as the case may be.You have the right not to be subject to an automatic data processing, including profiling and the right to notify the recipients regarding the rectification, deletion or limitation of your personal data.

Please be informed that the interference regarding the data you have provided may prevent the execution of the agreement concluded between you and the Law Firm. In this case, the lawyer/Law Firm is relieved of liability.

We inform you that, in the event you are a S&A client, considering the relationships that already exist with you/the company you represent, we hold some/all of your personal data and through this Note you agree that we continue with the processing of the data, on the basis of previous legal assistance agreements.

We kindly ask that you inform us about your requests in writing, in any way able to certify the identity of the solicitant and his entitlement, at our email address office@stratula.com. We will reply without delay.

If you are not satisfied, you have the possibility to address the Romanian Data Protection Authority (ANSPDCP).
